General Provisions

These Terms of Use apply to the sendigopro.com domain, including all subdomains, web pages, and mobile applications (collectively, "SendiGoPro"). The SendiGoPro platform is owned by "BARBADOS" d.o.o. Sarajevo, KSC Jošanička br. 33.

A "User" is any person who accesses and/or uses SendiGoPro services, including unregistered users, registered users, and business entities that use SendiGoPro services under a contractual relationship.

User Registration

By accessing SendiGoPro you accept these Terms of Use. We reserve the right to change, modify, or supplement these Terms at any time; changes take effect upon publication. By accessing SendiGoPro you are deemed to be acquainted with the current Terms of Use.

To use certain services, you may need to register and provide personal and contact information. Data is collected solely for the purpose of providing SendiGoPro services. The user warrants that submitted information is accurate and complete. SendiGoPro will use and protect personal data in accordance with applicable data protection laws. SendiGoPro services are available to persons aged 18 and over.

The user may request closure of their account and deletion of data at any time. Instructions will be sent to the user's email address.

The user is responsible for safeguarding their password and should change it periodically. The user is fully responsible for any damage arising from unauthorized use of access rights and for all content submitted under their account. SendiGoPro is not liable for password misuse but will act upon a reported incident.

SendiGoPro services are available to persons aged 18 and over.

What SendiGoPro Is (and Is Not)

SendiGoPro does not generate content on behalf of the user nor does it sell consumer databases. SendiGoPro is a multi-channel communication platform that allows users to purchase credits and use those credits to dispatch messages to their own contact lists via various communication channels (including, but not limited to, SMS, Viber, WhatsApp, and Email).

Prohibited Use

SendiGoPro may suspend or close accounts that violate these Terms. It is strictly prohibited to use the platform for:

1. Sending unsolicited bulk messages (SPAM) or messages without the recipient's prior consent.
2. Promoting unlawful acts, hate speech, or harassment.
3. Distributing malicious code, phishing links, or fraudulent schemes (e.g., "smishing").
4. Sending content that infringes on third-party intellectual property rights.

The user is solely responsible for the content of the messages they send and for ensuring they have obtained valid consent from recipients in accordance with applicable laws (such as GDPR). SendiGoPro maintains a zero-tolerance policy for spam; we reserve the right to block messages and suspend accounts immediately if spam activity is detected.

Liability

SendiGoPro utilizes third-party telecommunication providers and APIs to deliver messages. While we strive for high reliability, SendiGoPro is not liable for delivery failures caused by third-party carriers, incorrect phone numbers/emails provided by the user, or recipient-side blocking.

SendiGoPro reserves the right to determine the scope of intervention (including removal, blocking, or legal action) in cases of violations. In case of dispute, the competent court is in Sarajevo, Bosnia and Herzegovina.

Any disputes between users (including the accuracy of user data or any statements made by users) are resolved exclusively between those users. SendiGoPro is not liable for damages arising from such relations.

SendiGoPro is not liable for damages that may result from service interruptions, non-delivery of messages, misuse of publicly available information, or any costs the user may incur by using the platform.

Using the Service (Messaging & Credits)

Users may upload contact lists and create campaigns solely for the purpose of legitimate communication. By sending a message, the user confirms they have the necessary rights and lawful basis (consent) to contact the recipient.

Message pricing varies by channel (e.g., SMS vs. WhatsApp) and destination country. The specific credit cost per message is displayed within the platform. Credits are deducted from the user's balance upon submission of the message to the delivery network.

Only one account should be used per entity unless otherwise authorized. Campaign titles, sender IDs, and message bodies must not be misleading (e.g., impersonating banks or government entities). SendiGoPro may reject campaigns that are misleading, unlawful, or otherwise contrary to these Terms.

Payments

Paid services are settled via the purchase of "credits" using supported credit/debit cards or bank transfers as provided during checkout. Funds credited to a user account ("credits") may be used solely for SendiGoPro services, are non-transferable, and do not expire.

Where refunds are approved (e.g., technical failure attributable strictly to SendiGoPro platform errors), refunds are issued to the original payment method in accordance with applicable law and processor rules. Refunds are not issued for messages that fail due to invalid destination numbers or spam filters triggered by the user's content.

Data Processing & Retention

Uploaded contact lists and message logs are stored securely to facilitate service delivery, reporting, and campaign history.

SendiGoPro does not sell or share user contact lists with third parties for marketing purposes.

Data is retained for as long as the user account is active or as required by law for telecommunication record-keeping. The user may delete their contact lists from the system at any time.

Electronic Communications

Support and system notifications are intended solely for service-related communications (e.g., low balance alerts, maintenance). To prevent misuse, SendiGoPro may limit or disable account features without prior notice in case of suspected abuse or unusual traffic patterns.

Final Provisions

These Terms of Use apply and are effective as of 12.12.2025.
